Feature

This Boost Missions Feature (“Missions”) offered under the Boost Service is made available by Boost to you, subject to the Boost terms and conditions. You acknowledge that you have read and fully understood these terms and conditions. Your participation in the Missions, upon activation, constitutes unconditional acceptance to be bound by these terms and conditions as may be amended from time to time. In the event of a conflict or inconsistency between these terms and conditions and Boost terms and conditions, such inconsistency shall be resolved by giving precedence in the following decreasing order (i) these terms and conditions and (ii) Boost terms and conditions.

Duration of Feature This Boost Missions Feature is made available from 31 January 2019 and shall continue to be available until further notice is issued by Boost. Any extension or discontinuation of this Boost Missions Feature shall be at the sole discretion of Boost.

Eligibility 

This Feature is made available to all Boost users.

Feature Mechanics

a) Joining Boost Missions

1. Boost may from time to time at its discretion release missions (“Mission”) for you to participate.

2. The participation in Missions is on first come, first served basis and is limited to a fixed number of participants.

3. Some Missions are limited to one-time participation per user, while some allow for multiple participations per user.

4. You will need to opt in to a Mission to activate your participation. By participating in a Mission, you are deemed to agree to the terms and conditions of the respective Mission which may be found in the Mission briefs, as well as fulfil the respective Mission criteria in order to complete a particular Mission.

5. Selected users will automatically be opted in to selected targeted Missions. Such targeted Missions are not transferable to other users.

6. Each user can only have 4 activated Missions at any point in time.

7. Users may only participate in a particular Mission once unless stated in the respective Mission’s terms and conditions.

8. Users may, at any time, opt out from participating in any Boost Missions, including targeted Missions.

b) Completing Boost Missions

1. Spending transactions will only be reflected in the Boost Missions tracker after at least 5 minutes of each transaction.

2. Transactions will be accounted towards a mission only if that transaction would result in completing one (1) mission.

3. If a transaction results in more than one (1) missions being completed, only 1 mission would be accounted for based on the following order:

a) The mission with the highest reward;

b) If the rewards for missions are of the same amount, the mission with the earliest expiry period; and

c) If the missions are of the same expiry period, the mission with the earliest participating date.

4. If a transaction does not result in completing any mission but contribute to the progress of a mission (i.e. cumulative spend missions), that transaction would only be accounted for the progress of only one (1) mission based on the following order:

a) The mission with the highest reward;

b) If the rewards for missions are of the same amount, the mission with the earliest expiry; and

c) If the missions are of the same expiry, the mission with the earliest joining date.

c) Boost Missions Rewards

1. For each Mission that is completed, you will be rewarded with “Boost Coins” and/or cash rewards (“Mission Rewards”) in the Boost App which will be given to you as per the terms and conditions of the respective Mission. You may use Boost Coins earned to participate in other Missions.

2. You are required to claim your reward upon completion of the Mission. Boost may forfeit any reward which is unclaimed at its discretion.

3. Boost Coins used to participate in Missions are not refundable if a user fails or opts out from a Mission.

4. If a Mission is not completed within the prescribed time limit, you will not be eligible to get the Mission Reward and you Boost Coins used to participate in such Mission will not be refunded.

5. Mission Rewards are non-transferable and non-exchangeable.

6. Boost Coins cannot be exchanged for cash or e-money.

These terms for the Boost Loyalty Programme complement and incorporate by reference the Boost Terms and Conditions. In the event of any conflict between the Boost Terms and Conditions and these Boost Loyalty Programme terms, the Boost Terms and Conditions shall take precedence, save and except where the conflict is related to terms on Stars (as defined below) and/or the Boost Loyalty Programme, these terms for the Boost Loyalty Programme shall prevail.

Duration of Feature: This Boost Loyalty Programme is made available from 31 October 2019 and shall continue to be available until further notice is issued by Boost. Any extension or discontinuation of this Boost Loyalty Programme shall be at the sole discretion of Boost.

Eligibility: This Feature is made available to all Boost users.

1. Effective 1st November 2021, the reference to “Boost Coins” has been changed to and is known as “Boost Stars”. For clarity, you may/ may have seen that the Boost Loyalty Programme being referred to by Boost as “BoostUP Rewards Programme”. Please note that “Boost Loyalty Programme” and “BoostUP Rewards Programme” are used interchangeably and they have the same meaning.

2. By using the Boost Service, you will automatically be able to participate in the Boost Loyalty Programme to accumulate Boost Stars (“Stars”) and redeem rewards including, but not limited to e-vouchers and gifts offered by Boost and/or third party merchants listed in the rewards catalogue made available to you from time to time (“Rewards”). Upon your successful registration for a Boost account with Boost, you will be given free 200 Stars at the start of your membership in the Boost Loyalty Programme and you may commence earning Stars from eligible transactions under the Boost Loyalty Programme.

3. The Boost Loyalty Program is a tier-based program in which the membership tier (“BoostUP Rank”) is determined by the transaction amount accumulated within a quarter of a calendar year beginning on the date when first participated. The Boost Loyalty Programme offers four (4) membership tiers as follows: 
a. Rank 1: Red Recruit; 
b. Rank 2: Silver Sergeant; 
c. Rank 3: Gold General; and 
d. Rank 4: Platinum President (which is exclusively and solely for Boost Bank Berhad’s (formerly known as Boost Berhad) (“Boost Bank”) digital savings accountholders).

For clarity, if you join the Boost Loyalty Programme in the first quarter of a calendar year, your BoostUP Ranks will be assessed in the following quarter. Further, in the event that you are a Boost Bank digital savings accountholder, and you maintain your Platinum President status with Boost Bank (as may be further clarified in the Boost Bank’s Personal Banking Terms & Conditions), your BoostUP Rank will automatically be upgraded to BoostUP Rank 4: Platinum President, notwithstanding the transaction amount you accumulated within a quarter of a calendar year. However, in the event that you fail to maintain your Platinum President status with Boost Bank, your BoostUP Rank will be assessed in the following quarter based on your accumulated transaction amount in the preceding quarter.

4. Your BoostUP Ranks are reassessed at the end of every quarter of a calendar year in which the total transaction amount spent within a particular quarter of a given year may determine your BoostUP Rank in the following quarter. For clarity, the next assessment to determine your BoostUP Rank will be the end of the last quarter of 2021 (including for the users who join in November 2021). The review subsequent thereto would be at the of end the following quarter (i.e. first quarter of 2022).

5. Upon expiration of your BoostUP Rank tenure in a particular rank and if you have not made sufficient transaction amount to be retained in that tier, you may be moved/ downgraded to the next relevant membership rank.

6. For clarity, paragraphs 4 and 5 do not apply in the event that you maintain your Platinum President status with Boost Bank (and thus maintaining your BoostUP Rank 4: Platinum President).

7. You may earn Stars, in accordance with your BoostUP Rank (as set out in the table below), by making eligible transactions using your Boost Wallet. Notwithstanding anything herein, eCode may at its sole and absolute discretion assign the number of Stars to the respective BoostUP Rank. In addition to earning Stars through eligible transactions, you may receive additional bonus Stars (as set out in the table below) on spending made in the past calendar month should you maintain a 100% Online Banking Boost wallet Cash in the immediate past calendar month. (See note I below) For clarity, “100% Online Banking Boost wallet Cash in” means every and all cash in transaction made by you into your Boost wallet is via online banking.

Note I : The Online Banking Bonus will cease to be effective 1st July 2024, and thereafter there shall no longer be any earning of bonus Stars for cash in transaction into Boost wallet via online banking. 

8. Transactions which are not-eligible for earning Stars are set out below:
a. Peer-to-peer transfer;
b. Boost wallet Cash In;
c. Transactions on investment related products;
d. Zakat payments;
e. PTPTN payments;
f. entire or part of payments using Partner Wallet; 
g. payments made via non-Boost DuitNow QR codes; 
h. entire or part of payments using Pay with Stars; 
i. any other transactions that Boost may, from time to time, in its absolute discretion decide to be not-eligible for earning Stars.

For illustration purposes of Clause 7(f) above, if a User makes payment for a total amount of RM100, whereby RM10 is deducted from the User’s RM10 Partner Wallet and the remaining RM90 is deducted from the User’s Boost Wallet, the User will only be eligible to earn Stars for the RM90 deducted/ spent.

For illustration purposes of Clause 7(h) above, if a User makes a payment for a total amount of RM50, whereby a RM5 discount is redeemed with Boost Stars via the Pay with Stars feature and the remaining RM45 is deducted from the User’s Boost Wallet, the User will only be eligible to earn Stars for the RM45 deducted/ spent.

9. Stars will not be awarded if in Boost’s reasonable opinion the merchandise purchased will be used for resale or commercial use and any Stars awarded on such purchases will be forfeited without notice.

10. Stars are automatically added to your BoostUP account after performing a successful and valid transaction (eligible for earning Stars). If you void a transaction made with your Boost Wallet or if you request for a refund or return of purchases, Boost will deduct the Stars that you earned for that transaction, potentially resulting in a negative Stars balance.

11. Boost disclaims any responsibility in the event of errors in the crediting of Stars, other than in relation to errors resulting from its own negligence.

12. When enough Stars have been accumulated to obtain the Rewards (s) desired, you may use your Stars to redeem such Reward from the App. For clarity, the Stars have validity period, you should use the Stars accumulated by you to redeem Rewards within the timeframe stipulated, failing which the Stars (all or part thereof depends on its respective validity period) shall expire and shall be automatically forfeited at the absolute discretion of Boost and without notice to you.

13. For clarity, unless otherwise stipulated in the relevant Campaign’s terms and conditions, the Stars default validity period is a period of nine (9) months or three quarters, whichever comes earlier.  

14. In connection with the “FlexiRedeem” feature, you may redeem Rewards available under the “FlexiRedeem” tab on the BoostUP Rewards Catalogue in the App, using a combination of Stars accumulated and money from your Account (“FlexiRedeem Redemptions”) subject to the following. 
a. Stars used in FlexiRedeem Redemptions are subject to the same terms & conditions as regular Stars;
b. unless stipulated otherwise in the terms and conditions of FlexiRedeem Redemptions (if any), you will earn Stars for the money spent from your Account in FlexiRedeem Redemptions in accordance with your BoostUP Rank. For illustration purpose, if you spend RM10 and 1000 Stars on a FlexiRedeem Redemption, and you are ranked Silver Sergeant, you will earn 20 Stars from the said FlexiRedeem Redemption, unless otherwise stipulated in the terms and conditions.

15. Stars and where applicable, money, used to redeem the Rewards (including FlexiRedeem Redemptions) shall not be refunded or returned or exchanged in any kind. Once redemption for the Reward is completed, the said redemption cannot be cancelled.

16. All redeemed Rewards are provided to you strictly on an “as is” basis, and without any warranty of any kind, including any implied warranty of merchantability, fitness for purpose, non-infringement or non-misappropriation of intellectual property rights of a third party, accuracy, content or results. Boost shall not be liable for any liability, loss, damages, cost and/or expenses (whether direct or indirect), or for loss of revenue, loss of business, loss of profits or any consequential or indirect loss whatsoever as a result of your use and/or misuse of your redeemed Rewards.

17. You may have only one (1) Rewards account per Boost account that is personal to you. Your Boost Rewards are personal to you and they are not redeemable for cash (except for Boost credit where relevant) nor are they exchangeable for other Rewards under any circumstances. The Rewards cannot be sold (resold), exchanged or transferred for value under any circumstances, and they cannot be assigned to, or shared with, family, friends or others, or used by you for any commercial purpose. Your Boost Rewards shall not be regarded, construed, or used as valuable or exchangeable instruments under any circumstances.

18. The Rewards are subject to availability and may be changed by Boost at any time without notice. For clarity, Boost may at its sole and absolute discretion and without prior notice to you, reject your request to redeem Stars for any reason whatsoever, including without limitation, where:
a. there are insufficient Stars to redeem for a particular Reward; or
b. the Reward is no longer available or out-of-stock;
c. the Stars you wish to use for redemption of Rewards have been issued to you in error or have expired; or
d. Boost reasonably believes that that redemption transaction may be suspicious, illegal, involves any criminal activity or involves points that have been obtained through dishonest or fraudulent means or abusive behaviour.

19. Boost reserves the right to change, modify, discontinue or cancel the Boost Loyalty Programme or any part of the Boost Loyalty Programme, at any time and in its sole discretion, without notice to you. If the Loyalty Program is terminated, all unredeemed Stars will be forfeited without any obligation or liability, and no Rewards claims will be honoured thereafter.

20. The Stars conversion rate shall be at Boost’s discretion and the rate may increase or decrease as may be notified to you from time to time.

21. The Stars are for personal use only. The Stars have no cash or monetary value and are not redeemable for cash in any form and cannot be purchased, resold, exchanged or transferred, for value or otherwise, under any circumstances. The Stars shall not be regarded, construed, or used as valuable or exchangeable instruments under any circumstances.

22. You may also choose to use your Stars to participate in the BoostUP Pick & Win in the App which enables you to win Reward(s) by exchanging your Stars into entry(ies). (“Entries”)

23. Stars used to exchange for the Entries shall not be refunded or exchanged in any kind. Stars which you have exchanged for Entries in the BoostUP Pick & Win in the App will not refunded to you if you do not win any of the Rewards that you pick.

24. Winners of the BoostUP Pick & Win shall be notified within the App and via email to your email address registered with Boost and the redemption for the Rewards shall only be disclosed within the App in the “My Rewards” tab or via email to your email address registered with Boost.

25. If you fail to comply with any of these terms and conditions, we reserve the right to forfeit the Reward, or select another winner.

26. Your redemption of a Reward that is an e-voucher is subject to the additional terms and conditions of Boost or the third-party merchant (as the case may be) that offers the particular e-voucher that you wish to redeem.

27. You must use your e-vouchers redeemed during their applicable validity period failing which they will expire and be forfeited without further notice to you. You agree that you will have no claim whatsoever against Boost for any expired e-vouchers.

28. Your Stars balance and redemption entitlements will be reflected in the App and shall serve as a conclusive evidence of the same.

29. The benefits and privileges of each BoostUP Rank shall be as set out from time to time in the App.

30. You will automatically cease to be a member of the Boost Loyalty Programme when you deactivate your Boost account.

31. Upon your cessation to be a member of the Boost Loyalty Programme, all then outstanding Stars at such point of time shall be automatically cancelled and forfeited. Stars should be redeemed before ceasing membership as once cancelled and forfeited, Stars cannot be redeemed. No accumulation or carry over of Stars will be permitted even if you subsequently reinstate your membership.

32. Boost may, in its sole discretion, take such actions as it deems appropriate, including without limitation, suspending your benefits and/ or privileges under the Boost Loyalty Programme, revoking any or all of the Stars in your Boost Loyalty Programme account, and/or revoking your membership in the Boost Loyalty Programme, in each case, with or without advance notice to you and without liability to Boost in the event of fraud or abuse or redemptions or if Boost determines that a you have abused any of the Boost Loyalty Programme benefits and/ or privileges, have failed to comply with any of these terms and conditions set out hereinabove, or have made any misrepresentation to Boost.

These terms for the Boost Partner Wallet complement and incorporate by reference the Boost Terms and Conditions. In the event of any conflict between the Boost Terms and Conditions and these Boost Partner Wallet terms, the Boost Partner Wallet terms shall take precedence. Boost reserves the right to vary, modify or amend the terms and conditions of Boost Partner Wallet at its sole discretion without prior notice to you.

1. By using the Boost Service, you will automatically be able to use the Boost Partner Wallet feature which will enable you to :

a. Discover partner wallets (“Partner Wallet”) provided by Boost’s participating partners (“Partners”) and receive/pay with partner wallets;

b. View all Partner Wallets and their details (e.g. wallet amount, date validity, participating outlets and terms and conditions relevant to the respective Partner Wallet); and

c. Get Partner Wallet cashback which will be deposited in the relevant Partner Wallet.

2. You may receive Partner Wallet cashback:

d. Instantly after making a purchase using Boost at the Partner. Cashback will be given via shake reward; or

e. By redeeming the Partner Wallet cashback with Boost Coins.

3. Partner Wallet cashback which you have accrued will be automatically added to your Partner Wallet. You may use the Partner Wallet cashback for any of your next transaction using Boost with the same Partner.

4. You may not transfer the Partner Wallet cashback to your main Boost wallet, perform P2P, cash out your Partner Wallet cashback to your bank account or exchange your Partner Wallet cashback for cash or Boost coins.

5. Partner Wallet cashbacks are subject to the expiry date as stipulated in the respective Partner Wallet. Any expired cashbacks shall not be refunded or exchanged for cash or Boost coins. The expiry date for the Partner Wallet credits will not be extended in the case of a refund.

6. In relation to campaigns, if your Partner Wallet cashback expires within a Partner Wallet’s campaign period before you utilize such cashback and/or you have received the maximum amount of cashback for the respective Partner Wallet campaign, you will not receive any additional cashback under such Partner Wallet campaign.

7. In the event of void or partial void transaction performed using Partner Wallet cashback, such Partner Wallet cashback shall be restored to the respective Partner Wallet from which the transaction was performed. However, you will not receive any cashback which you are entitled to under such voided or partially voided transaction.

8. If there are more than one (1) active Partner Wallets, the Partner Wallet with the cashback which is expiring first will be utilized.

9. Only one (1) Partner Wallet may be used to make payment in a single transaction.

The terms below for the Boost Shake Rewards (“these Terms”) complement and incorporate by reference the Boost Terms and Conditions. In the event of any conflict between the Boost Terms and Conditions and these Terms, the Boost Terms and Conditions shall take precedence. Axiata Digital eCode Sdn Bhd (“Boost”) reserves the right to vary, modify or amend the terms and conditions of these Terms without any prior notice to the Boost users.

Duration of Feature
This Boost Shake Rewards feature is made available from 22 August 2022 and shall continue to be available until otherwise notified by Boost. Any extension or discontinuation of this Boost Shake Rewards shall be at the sole discretion of Boost.

Eligibility
This feature is made available to all Boost users.

Types of Shake Rewards
The Shake Rewards given under this Boost Shake Rewards feature, subject to these Terms, include cashback (introduced since 6 January 2025), voucher, and partner wallet.

Eligible Transaction for Other Reward
Save for Cashback (as defined below), subject to availability to receive other rewards under these Terms (“Other Reward”), the Boost users must spend a minimum amount of RM10.00 using Boost mobile application (“Boost App”) on any transaction except for the following:

  1. Peer-to-peer transfer;
  2. Boost wallet Cash-In;
  3. Transactions on investment related products;
  4. Zakat payments; and
  5. Perbadanan Tabung Pendidikan Tinggi Nasional (“PTPTN”) payments.
     

Eligible Transaction for Cashback
To receive cashback under these Terms, which is capped at RM8.00 only (“Cashback”), the Boost users must:

  1. have activated and enabled the Premium 10K account on the Boost App; and
  2. spend a minimum amount of RM1.00 only using Boost App on any transaction except for the following:
    a. Peer-to-peer transfer;
    b. Boost wallet Cash-In, other than a Cash-In via the Auto Add Money feature;
    c. payment using Boost Beyond Card: PayFlex as payment source; and
    d. Donations.
     

General
Boost users who receive Cashback under this Boost Shake Reward feature will still be entitled to receive the Other Reward under this Boost Shake Reward feature subject to these Terms herein. However, not all Boost users who receive the Other Reward under this Boost Shake Reward feature are entitled to receive Cashback under this Boost Shake Reward feature.

Feature Mechanics

1. Subject to these Terms, a Boost user may earn Other Reward and/ or Cashback by
(i) clicking on the Shake banner on the Boost App which appears on the top of the payment successful screen, or (ii) physically shaking the mobile device while still on the payment successful screen.

If a Boost user is also eligible to earn Other Reward (in addition to Cashback), “get more rewards” tab will appear at the bottom left of the payment successful screen. By clicking on that tab, the Boost user may earn Other Reward.

2. All redeemed Shake Rewards are provided to the Boost users strictly on an “as is” basis, and without any warranty of any kind, including any implied warranty of merchantability, fitness for purpose, non-infringement or non-misappropriation of intellectual property rights of a third party, accuracy, content or results. Boost shall not be liable for any liability, loss, damages, cost and/or expenses (whether direct or indirect), or for loss of revenue, loss of business, loss of profits or any consequential or indirect loss whatsoever as a result of the use and/or misuse of the redeemed Shake Rewards and/or unused Shake Rewards.

3. The Boost users will not be able to re-visit the Boost Shake Rewards feature if they have dismissed the Shake banner on the Boost App or exited the payment successful screen without physically shaking the mobile device. The Boost users will be required to complete a new transaction that meets the required minimum spend in order to be eligible to receive any Shake Rewards again.

4. The Shake Rewards are subject to availability and may be changed by Boost at any time without notice. For clarity, Boost may at its sole and absolute discretion and without prior notice to the Boost users, reject request to redeem reward(s) via the Boost Shake Rewards feature for any reason whatsoever, including without limitation, where:
a. There are insufficient amounts to redeem for a particular reward;
b. The reward is no longer available or out-of-stock by the partner;
c. The reward is fully redeemed;
d. Boost reasonably believes that the transaction made by you may be suspicious, illegal, involves any criminal activity or involves points that have been obtained through dishonest or fraudulent means or abusive behaviour.

Other Reward

5. The use of the Other Reward is subject to the relevant terms and conditions as displayed on their respective terms and conditions pages.

6. Each eligible Boost user will receive up to 3 attempts to redeem the Other Reward based on the transaction amount as follows:

Cashback

7. All redeemed Cashback via the Shake Rewards feature will be credited instantly into the Boost users’ Boost wallet.

8. In the event the Boost user requests for a refund of a performed transaction in which the Boost user earned the Cashback, such redeemed Cashback will be forfeited and the corresponding amount of such redeemed Cashback will be deducted from the Boost user’s Boost Wallet (or as the case may be, the refund amount will exclude the corresponding amount of such redeemed Cashback).
 

Terms and Conditions Governing the National Addressing Database 

In these Terms and Conditions (“Terms”), references to “You”, “Your” and “Yours” refer to the Boost wallet customer who uses the National Addressing Database (“NAD”) and references to“We”, “Our”, “Ours” and “Us” refer to AXIATA DIGITAL ECODE SDN BHD (Company No. 201701000820 (1214970-T)).

These Terms govern Your use of the NAD provided by Us and shall be read in conjunction with Boost General Terms and Conditions (as updated from time to time).

1. Definitions

Account” means an E-money account offered by issuers of e-money and all types of deposit accounts offered by banks, except for fixed deposit accounts. This shall include, but is not limited to, all types of conventional and/ or Islamic savings accounts, current accounts, investment accounts, virtual internet accounts.

Boost App” means the mobile application named as “Boost” or such other name as may be determined by Us from time to time, and operated by Us that offers e-money services by Us to Our users, i.e. You.

DuitNow ID” means an identifier of an account holder such as a mobile number, NRIC, passport number, army number or police number (in the case of an individual) or business registration number (in the case of a corporate customer) or any other identifiers as may be introduced by the NAD Operator from time to time.

DuitNow Transfer” means a service which allows customers to initiate and receive instant credit transfers using a recipient’s account number or DuitNow ID.

E-money account” means a payment instrument that stores funds electronically in exchange for funds paid to the issuer of e-money and is able to be used a means of making payment to any person other than the issuer of e-money.

Malware” means computer viruses, bugs or other malicious, destructive or corrupting software, code, agent, program or macros, and/or phishing or social engineering schemes which utilise computer software or telecommunications to obtain personal data or any other personal information for malicious or fraudulent purposes.

National Addressing Database” (NAD) means a central addressing depository established by the NAD Operator that links a bank or an e-money account to a recipients DuitNow ID and facilitates payment to be made to a recipient by referencing the recipient’s DuitNow ID.

NAD Name Enquiry” means a service which returns the name of the owner who has registered itsDuitNow ID in NAD.

NAD Operator” means Payments Network Malaysia Sdn Bhd (PayNet) (Company No.:200801035403 [836743-D])

Personal Data” means any information in respect of commercial transactions that relates directly or indirectly to a customer, who is identified or identifiable from that information which includes, but not limited to, the customer’s name, address, identification card number, passport number, banking information, email address and contact details. 

Common ID” means a unique identification of a customer which links all DuitNow IDs registered by the customer such as the customer’s NRIC, army number, or police number, or for non- Malaysians, passport number.

2. The NAD Service 

a. The NAD service allows You to link an Account that You have with Us to Your DuitNow ID.

b. By linking Your DuitNow ID to Your Account, You have the option of receiving incoming funds via DuitNow or any other payment services that address payments using Your DuitNow ID.

c. When You register Your DuitNow ID in NAD, You will also provide Us with Your Common ID which will be linked to Your Account with Your registered DuitNow ID. Your Common ID will be used by other NAD participating banks for the purpose of identifying You, as part of facilitating the DuitNow service.

d. You may link more than one of Your DuitNow ID to the same Account. However, You may notlink a particular DuitNow ID to multiple Accounts.

e. You may not transfer Your DuitNow ID to others or allow Your DuitNow ID to be utilized by any person other than You, including, but not limited to, for fraudulent or deceptive purposes.

3. Modification and Deregistration of your DuitNow ID

a. You may update or change Your DuitNow ID that is linked to Your Account via the channels made available to You. We will require a reasonable notice period to effect such changes or update.

b. You understand and agree that Your DuitNow ID that is linked to Your Account may be deregistered by You or by Us, due to the following circumstances:

i. You wish to transfer Your existing DuitNow ID to another Account in another bank/e-money issuer;

ii. You have changed/updated Your DuitNow ID;

iii. You have closed Your Account that is linked to Your DuitNow ID;

iv. the mobile number which You have provided to Us as Your DuitNow ID has been terminated and recycled for use by another person;

v. after a period of inactivity; or

vi. upon investigation, We find out that You or Your DuitNow ID is potentially involved inany fraudulent activity(s).

c. You agree that We or the NAD Operator may at any time deregister Your DuitNow ID or deny You the NAD service for reasons of security, prevention of fraud, suspicious activities and, in the case of the NAD Operator, for any reason the NAD Operator may deem fit.

d. You will receive a confirmation of de-registration from Us via Boost App as soon as the de-registration is confirmed.

4. Your Information

a. You represent and warrant that the DuitNow ID used for registration in NAD belongs to You, is correct, complete and up-to date for the use of the service and You will promptly notify Us if there is any change to the DuitNow ID information provided to Us. In the event that any information provided by You is fraudulent or deliberately misleading, You shall indemnify Us, Our affiliates and the NAD Operator for any losses caused by such provision of information or breach of the other provisions of these Terms.

b. You acknowledge and agree that other NAD participating banks/ e-money issuers may performa NAD Name Enquiry of Your DuitNow ID for the purpose of verifying/identifying Your name to Your registered DuitNow ID, as part of facilitating the DuitNow service.

c. You acknowledge and consent to the disclosure of Your DuitNow ID, Your Common ID and other relevant Personal Data to the NAD Operator for its processing, storing, and archival and disclosure to the sender of funds or merchants under the DuitNow services, Our affiliates, service providers, other NAD participants and third parties offering the DuitNow service and their respective customers.

d. You acknowledge and agree that We may disclose your DuitNow ID information to anyone who We are under an obligation to disclose information to under the law or where it’s in the public interest, for example to prevent or detect fraud and abuse.

5. Data Protection

a. Your consent and Our right to disclose information shall be in addition to, and without prejudice to the rights accorded to You under the Personal Data Protection Act 2010 and any other applicable laws in Malaysia.

b. We will only disclose, use and process Your DuitNow ID for the purpose of facilitating the DuitNow service.

c. We have in place, reasonable security measures (both technical and organisational) against unlawful or unauthorised processing of Your DuitNow ID.

d. We will notify You as soon as practicable if Your DuitNow ID is lost, destroyed, or becomes damaged, corrupted or unusable.

6. Liability

a. We and the NAD Operator shall not be liable for any losses or damage You may suffer as a result of, including but without limitation:

i. Your failure to maintain up-to-date information and Your failure to provide accurate information to us;

ii. Our compliance with any instruction given or purported to be given by You which is apparent to a reasonable person receiving such instruction;

iii. any misuse or any purported or fraudulent use of Your DuitNow ID including instances whereby online fraud is perpetrated by way of any Malware;

iv. any disclosure of any information which You have consented to Us collecting, using or disclosing or where such collection, Use or disclosure is permitted or required to be disclosed under the applicable laws in Malaysia.

7. Miscellaneous

a. You acknowledge that We have the right to change, vary or modify these Terms by providing You with thirty (30) days notice in such manner as We deem fit and You agree to be bound by such Terms as cancelled, revised or modified.

b. These Terms shall be construed in accordance with the laws of Malaysia and You agree to submit to the non-exclusive jurisdiction of the courts of Malaysia. 

 

In these DuitNow Transfer Terms and Conditions (“Terms”), references to “You”, ”Your” and “Yours” refer to the Boost wallet customer who is utilising the DuitNow Transfer service and has an account with Us and references to “We”, “Our”, “Ours” and “Us” refer to AXIATA DIGITAL ECODE SDN BHD (Company No. 201701000820 (1214970-T)).

These Terms govern Your use of the DuitNow Transfer provided by Us and shall be read in conjunction with Boost General Terms and Conditions (as updated from time to time). Capitalised terms used will have the same meaning as defined in Boost General Terms and Conditions unless stated otherwise.

Definitions

Account” means the electronic wallet account which You have maintained with Us that is accessed through Boost App at any given time.

Business Day” means any calendar day from Monday to Friday, except a public holiday or bank holiday in Kuala Lumpur.

DuitNow ID” means an identifier of an account holder such as a mobile number, NRIC, passport number, army number or police number (in the case of an individual) or business registration number (in the case of a corporate customer) or any other identifiers as may be introduced by the DuitNow Operator from time to time.

DuitNow Operator” means Payments Network Malaysia Sdn. Bhd. (Company No.: 200801035403 [836743-D]).

DuitNow Transfer” means a service which allows You to initiate and receive instant credit transfers using a recipient’s account number or DuitNow ID.

NAD Operator” means Payments Network Malaysia Sdn. Bhd. (Company No.: 200801035403 [836743-D]).

National Addressing Database (NAD)” means a central addressing depository established by the NAD Operator that links a bank account or an e-money account to a recipient’s DuitNow ID and facilitates payment to be made to a recipient by referencing the recipient’s DuitNow ID.

Personal Data” means any information in respect of commercial transactions that relate directly or indirectly to a customer, who is identified or identifiable from that information which includes, but not limited to, the customer’s name, address, identification card number, passport number, banking information, email address and contact details.

1. Introduction

1.1 These Terms apply to and regulate Your use of the DuitNow Transfer service offered by Us. The DuitNow Transfer service allows You to transfer an amount specified by You from Your designated Account maintained with Us, to a bank or e-money account maintained by Your recipient at a participating DuitNow Transfer participant via Pay-to-Account-Number and Pay-to-Proxy (Pay via DuitNow ID), or such other means as prescribed by Us or the DuitNow Operator from time to time.

1.2 The DuitNow Transfer service offered by Us is part of the Services, and accordingly these Terms are in addition to and shall be read in conjunction with the Boost General Terms and Conditions.  

2. DuitNow Transfer Services

2.1 If You wish to send funds via DuitNow Transfer, You must first be logged in to Boost App and initiate a payment by entering the recipient’s DuitNow ID.

2.2 We will perform a ‘Name Enquiry’ to verify the recipient’s registration of its DuitNow ID in NAD and if the recipient is registered, We will display the name of such registered DuitNow Transfer recipient.

2.3 You are responsible for the correct entry of the recipient’s DuitNow ID and ensuring that the recipient’s name displayed is the intended recipient of the funds prior to confirming the DuitNow Transfer transaction.

2.4 We will notify You on the status of each successful, failed or rejected DuitNow Transfer transaction via Our in-app push notification, or any of Our available communication channels as notified to You.

2.5 You acknowledge and agree We shall have no duty to and shall not be required to take any steps to verify or seek any other confirmation from any party as to whether such registered recipient is the intended recipient, and We shall not be liable for transferring the funds to such registered recipient even if such person is not the intended recipient.

2.6 Pursuant to Clause 2.5 above, You agree that once a DuitNow Transfer transaction has confirmed, it will be deemed irrevocable and You will not be able to cancel, stop or perform any changes to that DuitNow Transfer transaction.

3. Multiple Name Enquiry Requests

3.1 You are advised not to submit multiple “Name Enquiry Requests” without a confirmed DuitNow Transfer transaction. We shall not display the results of the “Name Enquiry Requests” upon five (5) consecutive Name Enquiry Requests that are not followed with a confirmed DuitNow Transfer transaction.

3.2 Without prejudice to any of Our rights and remedies, We reserve the right to terminate or suspend Your access to and use of the DuitNow Transfer service where We consider in Our sole discretion that inappropriate, fraudulent or suspicious use is being made of the DuitNow Transfer service, such as where multiple “Name Enquiry Requests” are submitted without a confirmed DuitNow Transfer transaction. You are advised to contact Us should You encounter any issues relating to the foregoing.

4. Recovery of Funds

4.1 You have rights in relation to the investigation and recovery of, erroneous payments and unauthorised (includes fraudulent) DuitNow Transfer transactions made from Your Account.

5. Erroneous DuitNow Transfer Transaction

5.1 If You have made an erroneous DuitNow Transfer transaction, You may request for recovery of the funds within ten (10) Business Days from the date the erroneous DuitNow Transfer transaction was made and We will work with the affected recipient’s bank/ e-money issuer to return the said funds to You within seven (7) Business Days provided the following conditions are met:

5.1.1 The funds were wrongly credited into the affected recipient’s account;

5.1.2 If funds have been wrongly credited, whether the balances in the affected recipient’s account is sufficient to cover the funds’ recovery amount;

5.1.2.1 If the balances are sufficient to cover the recovery amount, the erroneously credited funds may be recoverable; and

5.1.2.2 If the balances are not sufficient to cover the recovery amount, the erroneously credited funds may not be fully recoverable and the recipient’s bank/ e-money issuer may partially remit the recoverable fund back to You.

5.2 Request for recovery of funds between eleven (11) Business Days and seven (7) months from the date the erroneous DuitNow Transfer transaction was made:

5.2.1 The affected recipient’s bank/ e-money issuer is fully satisfied that funds were erroneously credited to the affected recipient;

5.2.2 Deliver notifications to the affected recipient in writing regarding the funds recovery requests whereby the erroneously credited funds would be recovered through debiting the affected recipient’s account within ten (10) Business Days of the notifications unless the affected recipient provides reasonable evidences that the affected recipient is entitled to the funds in question. After fifteen (15) Business Day, if the affected recipients fail to establish their entitlement to the funds, the affected recipient’s bank/ emoney issuer shall debit the affected recipients’ account and remit the funds back to You.

5.3 Requests to recover funds after seven (7) months from the date of the erroneous DuitNow Transfer transaction:

5.3.1 The affected recipient’s bank/ e-money issuer is fully satisfied that funds were erroneously credited to the affected recipient;

5.3.2 The affected recipient’s bank/ e-money issuer shall obtain from the affected recipient the decision whether to grant consent within ten (10) Business Days; and

5.3.3 Once consent is obtained, the affected recipient’s bank/ e-money issuer shall debit the affected recipient’s account and remit the funds back to You within one (1) Business Day.

6. Unauthorised or Fraudulent DuitNow Transfer Transaction

6.1 For DuitNow Transfer transactions which were not authorised by You or which are fraudulent, We will, upon receiving a report from You alleging that an unauthorised or fraudulent DuitNow Transfer transaction was made, remit the funds back to You provided the following conditions are met:

6.1.1 We shall conduct an investigation and determine within fourteen (14) calendar days, if the unauthorised or fraudulent payment did occur;

6.1.2 If We are satisfied that the unauthorised or fraudulent payment Instruction did indeed occur and was not caused by You, We shall initiate a reversal process whereby all debit posted to Your Account arising from the unauthorised or fraudulent payment instruction would be reversed.

7. Liability and Indemnity

7.1 You acknowledge and agree that, unless expressly prohibited by mandatory laws, We and the DuitNow Operator shall not be liable to You or any third party for any direct, indirect or consequential losses, liabilities, costs, damages, claims, actions or proceedings of any kind whatsoever in respect to any matter of whatsoever nature in connection with the DuitNow Transfer service offered by Us arising from:

7.1.1 Your negligence, misconduct or breach of any of these Terms;

7.1.2 Any erroneous transfer of funds by You, including any transfer of funds to the wrong DuitNow ID, wrong recipient or wrong third party;

7.1.3 The suspension, termination or discontinuance of the DuitNow Transfer service;

7.1.4 Any failure, delay, error or non-transmission of funds due to system maintenance, breakdown or non-availability of any network, software or hardware of Ours and the DuitNow Operator; or

7.1.5 Any unauthorized or fraudulent DuitNow Transfer transactions not caused by Us or attributable to Us.

7.2 You shall indemnify Us, Our affiliates, and the DuitNow Operator harmless from and against any loss or damage suffered due to any claim, demand, or action brought against Us, Our affiliates, and the DuitNow Operator resulting from Your negligent and/ or fraudulent act.

8. General

8.1 We reserve the right to revise at any time, such charges for the use of the DuitNow Transfer service, by providing You with thirty (30) days written notice. Such revisions shall take effect from the date stated in the notice. Where You continue to access or use the DuitNow Transfer service after such notification, You shall be deemed to have agreed to and accepted such revisions to such charges.

8.2 You acknowledge that We may terminate Your use of the DuitNow Transfer service with Us for any reason with prior notice.

8.3 You acknowledge that We have the right to change, restrict, vary, suspend or modify these Terms by providing You with thirty (30) days’ notice in such manner as We deem fit.

8.4 You consent to the collection, use and disclosure of your Personal Data by Us, Our affiliates, Our service providers and the DuitNow Operator as required for the purposes of the DuitNow Transfer service.

8.5 These Terms are governed by and shall be construed in accordance with the laws of Malaysia, and You hereby submit to the exclusive jurisdiction of the Malaysian courts.

1. Introduction and Application

1.1 These Boost UnionPay Terms and Conditions (“these Terms” or “this Agreement”) shall only apply to Boost users who activate and utilize the Boost UnionPay Service (as defined hereinbelow) (collectively, “Customers”, “you”, “your” and a “Customer” or “you” means anyone of them).

1.2 These Terms constitute a legally binding agreement between you and Axiata Digital eCode Sdn Bhd (Registration No.: 201701000820 (1214970-T)) (“Boost”, “we”, “our” or “us”) solely in relation to the operation of our mobile application, “Boost” (“Boost App”), which allows users to pay the Merchants accepting UnionPay cards using the Boost UnionPay Service within the Boost App.

1.3 By downloading the Boost App, and activating, using, and/ or authorizing the use of the Boost UnionPay Service in the Boost App, you agree to this Agreement, Boost’s terms of use, and privacy policies for the time being in force. You should not use the Boost UnionPay Service if you do not agree to be bound by any of these Terms.

1.4 These Terms shall apply to and govern your use of the Boost UnionPay Service through our Boost App. These Terms complement and incorporate by reference to our General Terms and Conditions for Use of Service (“General T&C”) (https://myboost.co/personal/general-terms-condition) and these Terms shall be read together with our General T&C and the terms of our Privacy Notice (https://myboost.co/privacy-policy). (These Terms, our General T&C and our Privacy Notice, including any amendment or supplemental thereto are collectively referred to as the “Agreements”). If there are any inconsistencies between these Terms and the terms in any of the other Agreements, these Terms shall prevail to the extent of the inconsistency in respect of the subject matter specifically addressed in such other terms. For the avoidance of doubt, provisions of the General T&C which are not stipulated in these Terms, shall also apply to you.

1.5 Unless expressly stated otherwise, these Terms do not supersede or replace any other consent you may have previously or separately provided to us in respect of your access or use of the Boost App and/or the Service (including the Boost UnionPay Service) and your consent to these Terms is in addition to any other rights which we may have in respect of your access or use of the Boost App and/or the Service (including the Boost UnionPay Service).

1.6 Unless expressly stated otherwise, the Definitions in our General T&C are applicable in these Terms.

2. Definitions

For ease of reference, the following definitions will apply:

“Agreement” or “these Terms”

means these Boost UnionPay Terms and Conditions;

 

“Available Balance”

means the actual amount of funds available in your Boost Account at any time for usage on Boost UnionPay Service;

 

“Boost”, “we”, “our” or “us”

means Axiata Digital eCode Sdn Bhd, the provider of the services within the Boost App which shall include successors and legal assigns;

 

“Boost App”

means Boost’s mobile application which is an application software running on a mobile device where you can enable or disable Boost UnionPay Service, your notification preferences, view Available Balance and Transactions details, and interact with Boost’s customer service;

 

“Boost UnionPay Service”

means a service in the Boost App which allows users to pay the Merchants accepting UnionPay Quick Response Codes (“UnionPay QR Codes”) and/ or Wei Xin Quick Response Codes (“WeChat QR Codes”), within Malaysia (“UnionPay Local”) and out of Malaysia (“UnionPay International”);  

 

“FAQs”

means frequently asked questions (including questions relating to the Boost UnionPay Service) as made available on https://support.myboost.co/hc/en-us/sections/38942915464729-Boost-UnionPay-Service, which may be updated from time to time; 

 

“Merchants”

means a retailer, or any other person, firm or corporation that accepts transactions via Boost UnionPay Service, either in- store, or through the internet;

 

“Payment Source”

is your chosen source(s) of the fund for your Transaction (i.e., your Boost Account, and such other sources as may be allowed by Boost in future);

 

“PDS”

means product disclosure sheets (including product disclosure sheet relating to the Boost UnionPay Service) that is made available on https://myboost.co/sites/default/files/2025-01/Boost_UPI_Product_Disclosure_Sheet.pdf, which may be updated from time to time;

 

“Transactions”

means all transactions effected through the use of the Boost UnionPay service, including but not limited to, retail transactions, e-commerce and other transactions, such as reload transactions and others;

 

“UnionPay”

means UnionPay International Co., Ltd, a real-time payment system provider and is a subsidiary of China UnionPay that provides high quality, cost effective and secure cross-border payment services;

 

“Website”

means the Boost website used for FAQs, PDS, customer service and other information pertaining to the Boost App, Boost Account and Boost UnionPay Service;

 

“You”, “Your”, “you” or “your”

Means the person who uses and/ or accesses the Boost UnionPay Service.

 

 

3. Declaration

By using the Boost App, activating, using, or authorizing the use of the Boost UnionPay Service in the Boost App, you hereby warrant, represent and declare that:

(a) you are a Boost wallet user, and you have an Account with Boost; and

(b) you acknowledge and agree that at any time should any of the representations, warranties and/or declarations above cease to be untrue or we discover to be untrue or that you have misrepresented the same, we shall be fully entitled at our sole and absolute discretion to suspend, block or terminate any Transaction(s) undertaken by you (if already undertaken) whereby there will be no refunds of the Transaction amounts or any applicable fees being refunded to you, and to take further and appropriate action which may include suspending, blocking and/or deactivating your Boost UnionPay Service, without any liability to you howsoever; and

(c) you acknowledge and agree that in order for us to provide you with the services, benefits, offers, and privileges related to Boost UnionPay Service, to manage your Transactions and Account, to facilitate the use of the feature and the processing of any transaction effected or to be effected through the use of the Boost UnionPay Service, the sharing, transfer, retrieval, updating, and processing of your personal information as well as the creation of member profiles and user accounts and updating of personal details may occur between Boost, our parent company, ultimate shareholder, our related companies, subsidiaries, associates and/or affiliates, our licensees, assignees, proposed assignees, representatives, agents, vendors, service providers (including partner networks), merchants, strategic partners, commercial partners, third- party contractors, payment network operators, and any other parties engaged by us to enable or assist us in the provision of services to you or to exercise or enforce our rights hereunder and/or any other party whomsoever as we may, to the extent at our sole and absolute discretion deem fit and necessary, within and beyond Malaysia, as stated in the Privacy Policy and you have consented to the same.

(d) you have read, understood, and accepted the terms and conditions contained in this Agreement and in connection with the activation for the Boost UnionPay Service and the use of the Boost UnionPay Service, and that they are legally binding on you.

(e) you will be solely responsible for your own personal payment settings, and Boost shall not be held liable for any errors or losses incurred or suffered by you as a result of any personal settings or information set or keyed in by you in your Boost Account in the Boost App.

4. Usage Restrictions

The activation of the Boost UnionPay Service (UnionPay Local and UnionPay International) is subject to certain conditions and usage restrictions. Notwithstanding all other conditions and restrictions stated in this Agreement, by using the Boost App to activate the Boost UnionPay Service (UnionPay Local and UnionPay International) and/or by retaining, using, or authorizing the use of the Boost App, the following terms apply:

• You must first enable UnionPay Local in the Boost App before activating UnionPay International to conduct international transactions.

• We may at any material time decide not to process your request or Transaction, especially if we suspect you are or may be involved in money laundering, terrorism financing, fraudulent, or illegal activities.

• The acceptance, processing, and/or settlement of any Transaction conducted by you with the Boost UnionPay service is subject to the acceptance of the same by the relevant payment network or the Merchant concerned. You agree that you will not hold us liable for any losses or damages resulting from the payment network’s or the Merchant’s decision not to accept, process, execute, or settle any Transaction conducted by you.

• You shall not provide any false, inaccurate, or misleading information or refuse to cooperate in any investigation or refuse to provide confirmation of your identity or any information requested by us.

• You shall not utilize the Boost UnionPay service to pay for products/services to be resold thereafter, or for illegal purposes or illegal Transaction or criminal activity of any nature. If we reasonably suspect or discover that you are using the feature to conduct any of the prohibited transactions under these Terms, or for any improper, illegal, or unlawful purposes, we may, in our sole and absolute discretion, cancel your Transaction and/or block, suspend and/or disable your Boost UnionPay Service without any liability to you howsoever.

• You may not use the Boost UnionPay service for any improper or illegal purpose and/or illegal Transaction, such as non-compliance with the applicable laws, money laundering, terrorism financing, unlawful activities, illegal online gambling, illegal purchase of controlled substances or prescription medication, purchase of firearms or explosives, fraud, prostitution, or child-trafficking, or financial support of terrorists or terror-supporting organizations.

• You acknowledge that Boost is not liable for your use of the Boost UnionPay service for any commercial purposes, including without limitation any risks associated with the purchase of goods or payment for services of any kind such as losses you may suffer for undelivered or defective goods and services you pay for using the service.

• You may not use any automatic device or manual process to monitor or copy the Boost App.

You acknowledge and agree that should you violate any of the conditions or restrictions abovementioned, we shall be fully entitled at our sole and absolute discretion to terminate any Transaction(s) undertaken by you (if already undertaken) whereby there will be no refunds of the Transaction amounts or any applicable fees being refunded to you, and to take further and appropriate action which may include suspending, blocking and/or disable your Boost UnionPay Service, without any liability to you howsoever.

5. Boost UnionPay Service: UnionPay Local and UnionPay International

• You agree to download and install the Boost App to setup and use the Boost UnionPay Service.

• You are required to enable the UnionPay Local and/or UnionPay International feature to be used by Boost App for deduction of funds via Boots UnionPay Service.

• You shall not use Boost UnionPay Service unless there are sufficient funds in your Boost Account. For clarity, the Available Balance excludes uncleared cheque(s) or remittances not received.

• Boost at its absolute discretion, without needing to give any reason(s), is entitled to refuse to act on any such instruction without incurring any liability whatsoever, including but not limited to, any of the following scenarios:

a. The funds/credit in your Boost Account is insufficient to effect, perform or process that instruction;

b. Your have exceeded the monthly transaction/transfer limit;

c. Your Boost Account is frozen or closed; or

d. Boost knows or has reason to believe that any fraud, criminal act, offence or violation of any law or regulation has been or will be committed.

• Authentication is required for any amount of financial transactions.

• You agree that the Boost UnionPay Service is only usable at participating Merchant accepting UnionPay Local and/ or UnionPay International.

• You understand that by using UnionPay Local and/ or UnionPay International through the Boost UnionPay Service to pay for local transactions and/ or cross border transactions, the amount will be deducted from your Boost Account.

• You are wholly responsible to ensure the transaction amount and the Merchant’s information displayed is correct prior to confirming the Transaction. The amount entered by you shall be deemed by Boost to be correct upon your confirmation of the Transaction. Boost is under no obligation whatsoever to verify that the amount paid or transferred matches with the Merchant’s amount.

• Boost will accept and act upon any instruction issued and/or transmitted via Boost UnionPay Service (whether authorized by the you or otherwise) as your authentic and duly authorized instruction. Boost shall be under no obligation whatsoever to investigate the authenticity or authority of person(s) effecting the instruction or verify the accuracy and completeness of the instruction. The instruction will be treated as valid by Boost notwithstanding any error, fraud, forgery, lack of clarity or lack of knowledge by the user in the terms of such instruction.

6. Fee and Charges

By entering into this Agreement, you agree and undertake to pay all fees arising out of and in connection with the use of Boost UnionPay service pursuant to this Agreement, which may include amongst others, account service fee, currency conversion fee, cross border transaction fee, charges for SMS Alert, sales draft retrieval fee, charges for load or reload of value, and such other fees and charges related to the Boost Account, as we and/or as the regulators may prescribe from time to time. We reserve the right to revise such fees or to charge additional fees (if applicable) for new services (which are optional) which may be offered by us from time to time.

As at the date of publication of these Terms, there are no additional fees for performing local transactions in Malaysia and international transactions overseas, using the Boost UnionPay Service via the Boost App.

7. Payment Source/ Source of Fund

Currently, the available source of payment is only the Available Balance, i.e. the available funds from your Boost Account.

It is important that you always ensure you have sufficient balance in your Boost Account prior to making any transaction.

8. Disputed Transactions – Goods/Services

We are not responsible and shall not be liable for the goods and services (including their delivery, performance, merchantability or fitness for purpose) purchased using Boost UnionPay Service, whether at the Merchant’s premises, written instructions sent by mail, email, facsimile, telephone order, online via the internet or any other means by which you have authorized the use of Boost UnionPay Service for the purchase of goods and services. Further, we are not responsible for the delivery, quality, safety, legality, fitness for purpose or any other aspect of the goods or services (including any defects or deficiency in any goods or services) purchased by you from Merchants using Boost UnionPay Service. All disputes involving the same should be addressed directly to the Merchants from whom the relevant goods and services were purchased. You agree to settle all disputes directly with the Merchant who honoured your payment or the member institution of UnionPay concerned and you shall pay us all amounts required under this Agreement despite such disputes. You shall not be entitled to setoff or counterclaim against us or to withhold payment to us on account of such complaint or under any circumstances whatsoever in respect of your claim against the Merchant or the member institution of UnionPay. We disclaim any liability for any claim you have against the Merchant or for any issues with regards the delivery, quality, safety, legality, fitness for purpose or any other aspect of the goods or services purchased by you from the Merchant.

9. UnionPay International: Transactions made in Foreign Currencies

If a Transaction is made in a foreign currency, UnionPay will convert the transaction into the Ringgit Malaysia equivalent at the conversion rate as determined by UnionPay as at the date it is processed by UnionPay.

Transaction history is available within the Boost App.

All entries in the transaction history are deemed true and accurate unless you inform us of any error, exception, dispute or unauthorized transaction within forty (40) days from the date of the transaction. If we do not receive any written notification from you concerning any error in the transaction history within the stipulated time frame, the transaction history shall be deemed true, complete and accurate, and you shall then be deemed to have accepted the entries in the transaction history made up to the date of the last entry in the transaction history as final and conclusive.

In the event the investigations and verifications conducted by Boost reveal that the disputed transaction(s) was (were) accurate, genuine and properly authorized by you, then you, the user shall be liable for all such disputed transaction(s).

You, the user further agrees to indemnify us, Boost against all other costs, expenses & charges that Boost may incur in the verification processes of the disputed transactions.

If you dispute any transactions stated in your history transaction, we may in our absolute discretion and as deemed fit conduct any investigation(s) regarding the disputed transaction(s) wherein the following shall apply:

(a) If our investigation(s) reveal or indicate that you are liable for any of the disputed transaction(s), we shall be entitled to levy the following charges: an investigation charge as we may deem fit to charge; from the date of the disputed transaction(s) until the finalization of our investigation(s).

(b) No investigation charge(s) shall be levied in the event that the investigation(s) reveal that you are not liable for any of the disputed transaction(s).

(c) Our findings in any investigation conducted in relation to your transaction shall be conclusive, final and binding on you and shall not be opened for questioning in any event.

10. Communication

You agree that we shall be entitled from time to time to contact you via electronic transmission (including, but not limited to within the App, email communication, telex, fax), SMS or via telephone correspondence and calls (which may be monitored and/or recorded by us), and any other means of exchange communication in respect of, but not limited to, matters in relation to confirmation of transactions, whether or not you transacted the same, and communication on promotions (and promotional items) for Boost UnionPay Service, and for any other matters relating to the Boost UnionPay Service.

You further agree that we shall be entitled to send you marketing materials, promotional offers and newsletters from time to time with regards to the Boost App, the Boost UnionPay Service, and other services provided by Boost. You may opt out from receiving such marketing communications by sending an email to [email protected].

11. Variation of Terms

Subject to the limitations of applicable law, we may at any time vary, revise, change, amend, withdraw, substitute or remove any of the terms and conditions of this Agreement.

Any such amendment shall be effective twenty-one (21) days after the revised terms have been posted on our Website or the Boost App, and thereafter such posting on the Website or the Boost App, the revised or new terms will apply to the service, including, without limitation, all future transactions made through Boost UnionPay Service.

We may issue such notice via in-App, email, electronic correspondence or any other modes of communication to you concerning any variation, revision, amendment, withdrawal, substitution, removal or change. Notwithstanding the foregoing, advance notice of any change may not be given if it is necessary to make any such change immediately in order to maintain or restore the security of the service or any related payment system.

If you do not accept the proposed variation, amendment, revision, substitution or change, you shall disable Boost UnionPay Service in your Boost App immediately.

Notwithstanding the above, we specifically reserve the right to withdraw or terminate the service (in whole or in part), any program, feature, function or benefit thereunder at any time with or without prior notice at our sole discretion. We may from time to time issue additional terms and conditions for the service, if required.

The latest version of these Terms will be available on the Boost App and the Website. We advise you to check these Terms regularly whenever you visit the Website or log- onto the Boost App to ensure that you are aware of our latest or updated terms and conditions of the services provided by Boost, including the Boost UnionPay Service.

12. Disclosure

Boost protects the privacy of your information as detailed in our Privacy Policy (please refer to the Privacy Policy section on the Boost App or the Website).

You acknowledge and agree that Boost shall be entitled to disclose, and you hereby irrevocably authorize, consent and covenant to the disclosure by Boost of, any information pertaining to you and/ or your activation for or use of Boost UnionPay Service, to any other authority having jurisdiction over Boost, its related corporations, associates, subsidiaries, affiliates, assignees, proposed assignees, agents and/ or any other parties engaged by Boost to enable or assist Boost to exercise or enforce Boost’s rights hereunder and/ or under any agreement for the provision of the services, benefits, offers and privileges related to the service and/ or any other Services by Boost to you, at its sole and absolute discretion as it deems fit.

You agree and authorize us to contact you, through any means, to make any inquiries and request additional information to validate any information we have on our records. Such inquiries may include, without limitation, mobile phone number verification, account verification, and requests for additional personal information. If we do not have your personal information, or you choose not to share or disclose any information that we may require, we may not be able to provide or continue to provide you with the service and we will not be obliged, responsible or held liable for the failure to provide the same (and/or any disputes in relation thereto).

Any disclosure by us of your information as set forth herein shall not render us liable to you for any claim, loss, damage (including direct or indirect damages or loss of profits or savings) or liability howsoever arising whether in contract, negligence, or any other basis arising from or in relation to: the release or disclosure of the information by us; and/or the information being incorrect, erroneous or misstated; and/or reliance on the information, whether caused by us or other third party’s misstatement, omission, negligence or default or by technical, hardware or software failures of any kind, interruption, error, omission, viruses, delay in updating or notifying any changes in the information or otherwise howsoever.

13. Costs and Expenses

You hereby agree that if we initiate legal proceedings against you because of a default in the terms of this Agreement, you shall be liable to pay to us all legal costs (including costs on a solicitor and client basis), other costs, charges and expenses which we may incur in enforcing or seeking to enforce any of the provisions of this Agreement or in obtaining or seeking to obtain payment of all or any part of the monies owing by you. Your responsibility for fees and costs shall not exceed the maximum amount allowed by law.

14. Indemnity

You agree to indemnify, defend and hold us and our parent company, ultimate shareholder, respective affiliates, related companies, officers, employees, agents, contractors, representatives, suppliers, vendors, service providers, partner networks and other related parties involved in the provision, processing and/or execution of services, benefits, offers and privileges related to the service, harmless from and against any claims, losses, damages, judgments, awards, costs, liabilities, expenses or fees (including without limitation reasonable attorneys’ fees) arising out of or in connection with your breach of this Agreement or your use of the services and/or the Boost App, any transaction, your breach of any Applicable Laws, or your violation of any rights of a third party including your use of any information or content obtained from or through your use of the service or the Boost App other than expressly permitted by this Agreement or of your negligence, fraud or wilful misconduct.

Boost reserves the right, at its own cost, to assume control of any defence or any other matter otherwise subject to indemnification by you, in which event you shall cooperate fully with Boost in asserting such available defences as elected by Boost in its reasonable discretion.

15. Service and/or Notification

You hereby agree that for service of any legal document, notification or statement hereunder or if any action is begun in the courts in Malaysia in respect of this Agreement, the legal process and other documents may be served by posting the documents to you (via ordinary post) at your last known address in our records and such service shall on the 5th day after posting, and shall be deemed to be good and sufficient service of such process or documents.

Any notice or other document to be given under this Agreement and all other communications by you to us with respect to any legal process shall be in writing and may be given or sent by hand, or registered post to us at the address set out below:–

16. Issues or complaints with respect to the service

You may also contact us by sending us an in-app message in the Help section of the Boost App for any queries or issues you may have regarding the service or to lodge any complaints with respect to the service or you may contact our customer service team via the contact details stated in the Mobile App or at [email protected].

17. Security

Boost treats the security of your Account with utmost priority and to this end, we use a variety of security measures to make sure that your Account is secure. However, it is your responsibility to ensure that your Account is kept safe from unauthorized access and attempts to use it for fraudulent purposes at all times. You must ensure that you do not share access of your Account with any person other than yourself and keep your login details safe. It is your responsibility to keep your Account secure and be responsible for all Transactions carried out using your Account. You should never conduct any Transactions on behalf of any third parties or allow any other individual to conduct a Transaction on your behalf. You should never use the Boost App or submit any Transactions on a ‘jailbroken’, ‘rooted’ or otherwise modified device. In addition, you must only download or use the Boost App on mobile devices installed with the latest and most secured operating system(s) available for the mobile device. If you find or suspect any unauthorized use of your Account or any other security breach, you must notify us immediately using any of the contact methods provided above so that we can take all the necessary steps to prevent further unauthorized use.

Where you have notified us, or we reasonably believe that your Account has been compromised, we may stop, block or suspend your access to and use of your Account and/or the services. We also have the right to disable or change any username or password (if possible), whether chosen by you or provided by us to ensure the security of the Account, in our sole discretion. Note that any act or omission of Boost in relation to any steps to be taken as set out above does not make Boost liable to you for any loss or damage arising from the result of your failure to keep your Account secure and notifying us of the same.

If you believe that a Transaction was made without your authorization, you must contact us immediately. We will conduct an investigation and may provide refunds of unauthorized Transactions unless:

• you have acted fraudulently; you have intentionally or negligently compromised the security of your Account or failed to keep the details you use to access your Account secure; or

• otherwise due to termination by Boost due to events of default caused by you or due to suspicious, fraudulent, unusual, irregular or unauthorized activity.

If our investigations result in any special circumstances deviating from the above and affect the outcome of your liability and/or eligibility for a refund, we will notify you. Note that we have no responsibility towards you for any loss caused by unauthorized access prior to you notifying us. A charge may also be applied for any refund request if the unauthorized use, loss, theft or misuse of your Account was caused by your error, carelessness or negligence.

In cases where we have reason to believe that you have acted fraudulently, we may decide not to allow any refund to you, investigate the circumstances further or even forward the matter to the law enforcement authorities. If an investigation (whether by us or the authorities) results in a finding of fraud by you, we may charge you for costs incurred by us in carrying out such investigation and further deduct these monies from your Account. If you think you have been or might be a victim of fraud, please contact us immediately.

We also regularly monitor the apps distribution platforms and will report fake mobile applications to the app distribution platforms for their further action to prevent such fake mobile applications from being made available for download by users. We also monitor sources identifying fake/phishing websites and will take the necessary action to report the same to the appropriate parties (overseeing or hosting these sites) for the same to be taken down in order to safeguard users from falling prey to scams or fraud sites guising as Boost’s official website. In any event, users can validate the authenticity of the Boost App through Apple’s App Store and Google’s Play Store, as the mobile application is signed by Boost. Notwithstanding, you must only download the Boost App from either Apple’s App Store or Google’s Play Store or Huawei App Store. You must not download the Mobile App from any other app sites, websites or app forums as they will probably be fake or phishing sites which we do not authorize or approve to publish the Boost App.

18. Waiver

Our acceptance of any terms or payments or any waiver by us of our rights or any indulgence granted to you shall not operate to prevent us from enforcing any of our rights hereunder this Agreement nor shall such acceptance operate as consent to the modification of any of the terms of this Agreement in any respect nor shall such waiver of rights affect our other legal rights.

The rights and remedies provided in this Agreement are cumulative and not exclusive of any rights or remedies provided by law.

19. Assignment

We shall be entitled at any time without your consent to assign the whole or any part of our rights or obligations under this Agreement with or without notice to you. This Agreement and/or service shall not be assigned by you to any other third party without our written consent.

20. Successors Bound

This Agreement shall be binding upon and inure to the benefit of our respective successors in title and assigns provided that you may not assign your rights and obligations under this Agreement without our prior written consent.

21. Severability of Provisions

If any of the provisions of this Agreement becomes or is determined to be invalid, illegal, or unenforceable in any respect under any law, rule or regulation, the remaining terms of this Agreement shall not be affected, and all other provisions of this Agreement will still be valid and enforceable.

22. Governing Law and Jurisdiction

This Agreement shall be governed and construed in accordance with the laws of Malaysia. You consent and agree to submit to the exclusive jurisdiction of the courts of Malaysia concerning all matters arising out of or in connection with your use of the service under this Agreement.

23. Provision of Further Documents

You undertake to provide or execute such further documents as may be requested by us from time to time (if required).

24. Notification of Change in Personal Details

You should always ensure that you provide us with your most updated and current personal particulars and information, including your mailing and correspondence/permanent address, contact number, electronic mail address and other required details in order to ensure that your records with us are kept up to date, complete and accurate. If any information supplied by you changes during the course of service usage with us, you should notify us immediately to enable us to update your information in our records.

Any notice given by us shall be deemed given to you if sent by electronic or postal mail to the last known mailing/correspondence address of you, the user as shown on our records.

Boost shall NOT accept any notification of addresses (business, office, residential or correspondence address) bearing a P.O. Box.

25. Features and Benefits Renewable

In line with our commitment to upgrade the Boost UnionPay Service and benefits we may review and revise any of the features and benefits appearing in the Boost App or the Website or listed in any brochures or communication materials printed by us from time to time.

26. Use of the Boost App – Terms of Use
In addition to the foregoing terms and conditions, when you use the Boost App or the Website, the terms of use governing the Boots App and the Website (if any) shall apply in addition to and not in substitution for any terms and conditions contained in this Agreement.

27. Language

In the event of any inconsistencies between this Agreement and its translation in any other language, the English language version of this Agreement shall supersede and prevail over any other language.

 

In these DuitNow QR Terms and Conditions (“Terms”), references to “you”, “your” and “yours” refers to the Boost wallet customer who is utilising the DuitNow QR Service and has an account Us and reference to “we”, “our”, “ours” and “us” refers AXIATA DIGITAL ECODE SDN BHD (Company No. 201701000820 (1214970-T)).

These Terms govern your use of the DuitNow QR provided by us and shall be read in conjunction with Boost General Terms and Conditions (as updated from time to time). Capitalised terms used will have the same meaning as defined in Boost General Terms and Conditions unless stated otherwise.

Definitions

Account” means an E-money account offered by issuers of E-Money and all types of banking accounts offered by banks, except for fixed deposit accounts. This shall include, but is not limited to, all types of conventional and/or Islamic deposit accounts, current accounts, virtual internet accounts, and/or conventional and/or Islamic investment accounts. Additionally means all line of credit accounts tied to payment cards where transaction is made.

Acquirer” means an operator of a payment system that provides merchant acquiring services to accept DuitNow QR service for payment.

Business Day” means any calendar day from Monday to Friday, except a public holiday or bank holiday in Kuala Lumpur.

Cross-Border QR” means a service which facilitates point-of-sale payments to Foreign Merchants by scanning the QR Codes issued by the Participating Switches.

Dynamic QR” means a QR Code that is generated on-demand and usually has an expiry. Dynamic QR generally requires the Merchant or Recipient to key-in the amount of the payment or credit transfer.

E-Money” means a payment instrument that stores funds electronically in exchange for funds paid to the issuer of E-money and is able to be used a means of making payment to any person other than the issuer of E-money.

Foreign Merchant” means an individual who is residing outside Malaysia, or a company, body corporate, business (including sole proprietor and partnership) incorporated outside Malaysia that accepts payments via Cross-Border QR service, for purchase of goods and/or services.

Issuer” refers to the bank or e-wallet provider who issue designated QR Code that allows customers to make payments using their Account.

Merchant” means individuals, businesses including sole proprietors, partnerships and companies registered with the Companies Commission of Malaysia, government agencies, statutory bodies, societies, and other similar legal entities that accepts payments via DuitNow QR service for purchase of goods and/or services. 

DuitNow QR” means a service which facilitates industry wide ubiquitous payments or credit transfer by scanning the QR Code which complies with DuitNow National QR Standard.

DuitNow QR Owner & Operator” means Payments Network Malaysia Sdn Bhd (Company No.: 200801035403 [836743-D]).

DuitNow QR Service” means the services offered under Clause 2 of these Terms.

Participating Switch” means a foreign institution that collaborates with the DuitNow QR Owner & Operator to provide the Cross-Border QR service in its respective country to its Acquirer or Issuer (as the case may be).

Recipient” means an individual who receives funds via the DuitNow QR Service. 

Static QR” means a QR Code that is pre-generated for display and usually has no expiry. Static QR generally requires the individual to key-in the amount of the payment or credit transfer.

QR Code” means a two-dimensional barcode that can be read using the camera of a smartphone or mobile device that is equipped with QR reader.

1. Introduction

1.1 These Terms apply to and regulate your use of the DuitNow QR Service offered by us. The DuitNow QR Service allows you to transfer funds from your designated Boost Wallet to a Merchant’s or Recipient’s Account by scanning the Merchant’s or Recipient’s QR Code. This service also allows you to transfer funds to the Merchant by generating a QR Code to be scanned by the Merchant.

1.2 The DuitNow QR Service offered by us is part of the services of the Boost wallet, and accordingly these Terms are in addition to and shall be read in conjunction with the Boost General Terms and Conditions applicable to the use of the Boost wallet and in the event of any irreconcilable conflict, these Terms shall prevail to the extent that the usage of the Boost wallet relates to the DuitNow QR Services. 

1.3 The Cross-Border QR service is an extension of DuitNow QR Service which allows you to transfer funds to a Foreign Merchant’s Account by scanning the QR codes issued by Participating Switches. Reference to DuitNow QR unless inconsistent with the context in these Terms & Conditions shall also refer to Cross-Border QR.

2. DuitNow QR Service

2.1 If you wish to send funds via DuitNow QR, you must first select an Account to be used by Boost Wallet for deduction of funds for transactions made via DuitNow QR. Boost Wallet mobile application enables you to either perform a push payment by scanning a Static QR Code or a Dynamic QR Code displayed by the Merchant or Recipient, or perform a pull payment by generating a Dynamic QR Code on a mobile device to be scanned by the Merchant.

2.2 You are responsible for ensuring that the transaction amount keyed-in or displayed on your mobile application screen is correct prior to confirming the transaction. The transaction amount keyed-in or displayed via the Merchant’s or Recipient’s QR Code shall be deemed by Boost Wallet to be correct upon your confirmation of the transaction. Boost Wallet is under no obligation whatsoever to verify that the amount paid by you matches with the Merchant’s or Recipient’s amount.

2.3 We will notify you on the status of each successful DuitNow QR transaction via any of our available communication channels chosen by you.

2.4 You acknowledge and agree that we shall have no duty to and shall not be required to take any steps to verify or seek any other confirmation from any party as to whether such Merchant or Recipient is the intended party to receive the funds, and we shall not be liable for transferring the funds to such Merchant or Recipient even if such person is not the intended party.

2.5 Pursuant to Clause 2.4 above, you agree that once a DuitNow QR transaction is confirmed, it will be deemed irrevocable and you will not be able to cancel, stop or perform any changes to that DuitNow QR transaction.

3. Recovery of funds 

3.1 You have rights in relation to the investigation and recovery of erroneous or mistaken DuitNow QR transactions as stated in Clause 4 and unauthorised or fraudulent DuitNow QR transactions as stated in Clause 5 made from your Account. However, we do not guarantee that any funds therefrom will always be recovered and we shall not be in any way liable for any such unrecoverable loss and the provisions of Clauses 4 and 5 are made subject to this Clause 3. The recovery of any funds may be subject to fee charges.

3.2 For Cross-Border QR service, all payment disputes shall be raised within 30 calendar days from the date of transaction. We and the DuitNow QR Owner & Operator reserve the right to reject any disputes that were raised by you after the said duration.

3.3 You acknowledge that you are fully responsible to ensure that the usage of the DuitNow QR Service on your mobile device fully complies with these Terms and you shall safeguard your mobile device and take steps to ensure that no improper, illegal, fraudulent, and/or unauthorised transactions occur using the DuitNow QR Service. All DuitNow QR transactions occurring on your mobile device are deemed to have been initiated by you or with your consent, unless proven otherwise.

4. Erroneous or Mistaken DuitNow QR Transaction

4.1 If you have made an erroneous or mistaken DuitNow QR transaction, you may request for recovery of the funds. Within ten (10) Business Days from the date of your recovery of funds request, we will work with the affected Merchant’s or Recipient’s bank to return the said funds to you within seven (7) Business Days, provided the following conditions are met:

4.1.1 The funds were actually wrongly credited into the affected Merchant’s or Recipient’s Account;

4.1.2 If funds have been wrongly credited, whether the balances in the affected Merchant’s or Recipient’s Account is sufficient to cover the funds recovery amount:

4.1.2.1 If the balances are sufficient to cover the recovery amount, the erroneously credited funds may be recoverable; or

4.1.2.2 If the balances are not sufficient to cover the recovery amount, the erroneously credited funds may not be fully recoverable.

4.2 For requests for recovery of funds between eleven (11) Business Days and seven (7) months from the date the erroneous transaction was made, we will work with the affected Merchant’s or Recipient’s bank to return the said funds to you within seven (7) Business Days, provided the following conditions are met:

4.2.1 The affected Merchant’s or Recipient’s bank is fully satisfied that funds were erroneously credited to the affected Merchant or Recipient;

4.2.2 The affected Merchant’s or Recipient’s bank must deliver notifications to the affected Merchant or Recipient in writing regarding the funds recovery requests, whereby the erroneously credited funds would be recovered through debiting the affected Merchant’s or Recipient’s Account within ten (10) Business Days of the notifications unless the affected Merchant or Recipient provides reasonable evidence that the affected Merchant or Recipient is entitled to the funds in question. After fifteen (15) Business Days, if the affected Merchant or Recipient fails to establish their entitlement to the funds, the affected Merchant’s or Recipient’s bank shall debit the affected Merchant’s or Recipient’s Account and remit the funds back to you.

4.3 For requests to recover funds after (7) months from the date of the erroneous transaction was made, we will work with the affected Merchant’s or Recipient’s bank to return the said funds to you within seven (7) Business Days, provided the following conditions are met:

4.3.1 The affected Merchant’s or Recipient’s bank is fully satisfied that funds were erroneously credited to the affected Merchant or Recipient;

4.3.2 The affected Merchant’s or Recipient’s bank shall obtain from the affected Merchant or Recipient the decision whether to grant consent to debit the Merchant or Recipient account within ten (10) Business Days; and

4.4 Once consent is obtained, the affected Merchant’s or Recipient’s bank shall debit the affected Merchant’s or Recipient’s Account and remit the funds back to you within one (1) Business Day.

5. Unauthorised or Fraudulent DuitNow QR Transaction

5.1 For DuitNow QR transactions which were not authorised by you or which are fraudulent, we will, upon receiving a report from you alleging that an unauthorised or fraudulent DuitNow QR transaction was made, remit the funds back to you, provided the following conditions are met:

5.1.1 We shall conduct an investigation and determine, within fourteen (14) calendar days, if the unauthorised or fraudulent payment did occur;

5.1.2 If we are satisfied that the unauthorised or fraudulent payment instruction did indeed occur and was not caused by you, we shall initiate a reversal process whereby all debit posted to your Account arising from the unauthorised or fraudulent payment instruction would be reversed.

6. Liability and Indemnity

6.1 You acknowledge and agree that, unless expressly prohibited by mandatory laws, we and the DuitNow QR Owner & Operator shall not be liable to you or any third party for any losses, liabilities, costs, damages, claims, actions or proceedings of any kind whatsoever in respect to any matter of whatsoever nature in connection with the DuitNow QR Service offered by us arising from:

6.1.1 Your negligence, misconduct or breach of any of these Terms;

6.1.2 Insufficient funds in your Account for us to process the DuitNow QR transaction;

6.1.3 You have exceeded your daily transfer limit;

6.1.4 Any payment instruction given or purported to be given by you;

6.1.5 Any erroneous transfer of funds by you, including any transfer of funds to the wrong Merchant or Recipient or wrong third party; or

6.1.6 The suspension, termination or discontinuance of the DuitNow QR Service.

6.2 You shall indemnify and hold us, our affiliates, and the DuitNow QR Owner & Operator harmless from and against any loss or damage suffered due to any claim, demand, or action brought against us, our affiliates, and/or the DuitNow QR Owner & Operator resulting from any negligent and/or fraudulent act to the DuitNow QR T&C by you.

6.3 You shall indemnify us and our affiliates for any liability, claim, loss, damage or expense of any kind or nature arising directly or indirectly, as a result of your actions or omissions in relation to the usage of the DuitNow QR Service or any failure to comply with these Terms

7. General

7.1 We reserve the right to revise at any time, such charges for the use of the DuitNow QR Service, by providing you with thirty (30) days written notice. Such revisions shall take effect from the date stated in the notice. Where you continue to access or use the DuitNow QR Service after such notification, you shall be deemed to have agreed to and accepted such revisions to such charges.

7.2 You acknowledge that we may terminate your use of the DuitNow QR Service with us for any reason, with prior notice.

7.3 You acknowledge that we have the right to change, restrict, vary, suspend or modify these Terms by providing you with thirty (30) days’ notice in such manner as we deem fit.

7.4 You consent to the collection, use and disclosure of your personal data (including contact details) by us, our affiliates, our service providers and the DuitNow QR Operator as required for the purposes of the DuitNow QR Service.

7.5 These Terms are governed by and shall be construed in accordance with the laws of Malaysia, and you hereby submit to the exclusive jurisdiction of the Malaysian courts.
